Here is a link to Radio National’s most recent Background Briefing program, in which I appear as a commentator on the potential invalidity of a bilateral treaty between Timor-Leste and Australia.  It is alleged that Australian agents secretly bugged the government of Timor-Leste during negotiations in order to obtain an upper hand in the talks.  If true, it seems clear that Timor-Leste has a viable claim that the treaty is invalid on account of fraud under Article 49 of the Vienna Convention on the Law of Treaties to which both Australia and Timor-Leste are parties.  For more detailed thoughts see this short paper I put up at SSRN.
